ADULT GUARDIANSHIP:
A guardian is a person appointed by the Probate Court to make legal decisions for an incapacitated individual. A guardian may consent to medical care, nursing home placement, and a Do Not Resuscitate Order. ADULT CONSERVATORSHIP:
A conservator is a person appointed by the Probate Court to care for money and assets of an incapacitated individual. The conservator takes control of any bank accounts or other money, real estate, stocks and bonds, mutual funds, or other assets owned by the individual. The conservator is to then conserve and preserve the assets for the benefit of the individual and spend any money reasonably necessary for the care and support of the individual. If there is insufficient cash to pay the individual’s expenses, the conservator may request the Court approve selling assets, such as a home, other real estate, or mutual funds. DURABLE POWER OF ATTORNEY ABUSE:

PROBATE ESTATE ADMINISTRATION:
There are two types of decedent’s estate administration – Supervised and Unsupervised. In both types, the Oakland County Probate Court appoints a Personal Representative to administer the estate from funeral arrangements at the beginning, through distribution of assets, to estate closing at the end. You must perform your fiduciary duties solely for the best interests of the estate’s interested persons.
